Charlie Baker signed into law a bill that repeals most of a 1989 tough-on-crime measure that automatically suspends the driver's license of a person convicted of drug crimes. The bill, which passed unanimously in both chambers, also waives a $500 reinstatement fee drug offenders had to pay to get their licenses back. “As the Commonwealth takes important steps to battle substance abuse and reexamine our criminal justice system, I am pleased to sign legislation providing opportunities for those convicted of drug offenses and who have served their time to re-enter society, find and keep a job and support their families,” Baker, a Republican, said in a statement. About 7,000 people had their licenses suspended in 2015 — even if the drug conviction did not involve operating a vehicle, Senate President Stan Rosenberg, a Democrat, said in the governor's office statement. And of those people who had their licenses suspended, a senator had previously testified, about 2,500 were able to pay the reinstatement fee, while another 700 were rearrested for driving without a license. The new law, which takes effect immediately, provides exceptions for the suspension of licenses of people convicted of serious drug trafficking crimes and for those convicted for driving under the influence of drugs. The city has also agreed to pay Linson Tara’s attorney fees in an amount to be determined later by U.S. District Judge John Coughenour. The lawsuit, in addition to alleging that officers Brent Frank and Mike Boehmer used excessive force, challenged the constitutionality of the city’s de-facto policy of allowing police dogs to bite suspects as a “pain compliance” technique. The 9th Circuit Court of Appeals has held that the use of a K-9 bite is “the most severe force authorized short of deadly force.” Acting Deputy Chief Rick Mitchell declined to comment on the settlement when reached by phone on Friday. The department’s attorney, Andrew Cooley, described the arrest as a “tense and rapidly evolving event, where the silent video captures only part of what happened.” Officers Frank and Boehmer responded the evening of Aug. 22, 2014, to a report of a man in the Tukwila UPS freight yard, “walking around, yelling and dancing,” according to a complaint filed in federal court. They arrived to find Tara, who did not work there, being confronted by a number of employees. Police-dashcam video shows him standing with one hand on hip and the other held up, palm open. Frank, the K-9 officer whose dog, Ace, can be heard barking in the background, approaches Tara and tries to lead him toward the police cruiser. Detention Center) MAYO, SC (FOX Carolina) - A Fingerville man faces multiple charges after troopers with the SC Highway Patrol said he crashed while driving drunk with young children in his vehicle. William Henderson, 25, crashed when he turned left in front of an oncoming 18-wheeler along Highway 110 in the Mayo area of Spartanburg County Tuesday, troopers said. Troopers said five children were in the car at the time; ranging in ages from 11 months to 7-years-old. Troopers said all children except the 7-year-old should have been in child seats but only two were properly restrained. Troopers said Henderson and all five children were taken to the hospital. Henderson was charged with two counts of felony DUI with great bodily injury, one count of child endangerment, driving under suspension first offense, open container of beer or wine in vehicle, and unlawful communication. During a bond hearing Wednesday afternoon at the Spartanburg County Detention Center, the solicitor's office revealed that two of the children injured in the crash remained hospitalized with head injuries and were in serious condition. Solicitor Barry Barnette said the three other children have been placed in DSS custody, but the family maintains that is not true. The mother of the five children, who is Henderson's ex-girlfriend, came to his defense Wednesday. "He's devastated over the situation," said Amber Moore, who has spent the last day at Greenville Memorial Hospital with her two children who were seriously injured. Troopers said the accident happened just after midnight between the 19 and 21 mile marker. Cpl. Bill Rhyne said Samantha Bishop, 32, was driving on I-26 when she crossed the cable barrier and struck another vehicle in the oncoming lane. Rhyne said Bishop was arrested and charged with DUI and driving under suspension. TRAVELERS REST, SC (FOX Carolina) - The Travelers Rest Police Department is investigating the sexual abuse of a young child. Police said on June 4, they received a complaint regarding two sexual assaults of a minor under the age of 11 years old in November and December of 2015. According to arrest warrants, 55-year-old William Lee Carpenter Jr. is accused of first-degree sexual battery with the child. Regina Gail Owings, 45, is accused of restraining the victim by holding the child down by the shoulders while Carpenter committed one of the acts. Carpenter and Owings were arrested on Sunday after an investigation revealed probable cause. Both were denied bond by a judge and are currently being held at the Greenville County Detention Center.
